RE: The tariff classification of women's woven wearing apparel from Hong Kong

Dear Ms. Shelsy:

In your letter dated March 22, 1996, you requested a classification ruling. The samples submitted with your request will be returned to you under separate cover. Style 2433 is a dress constructed from woven fabric that is 55 percent polyester/25 percent wool/15 percent acrylic and 5 percent other fibers. The fully lined, sleeveless dress features a v-neckline and a full front opening secured by seven buttons.

Style 2434 is a dress constructed from woven fabric that is 55 percent polyester/25 percent wool/15 percent acrylic and 5 percent other fibers. The fully lined, sleeveless dress features a round neckline, an empire waist and a back zipper closure.

Style 2442 is a dress constructed from woven fabric that is 50 percent acrylic/40 percent wool and 10 percent polyester. The fully lined sleeveless dress features a scoop neckline, one inch wide shoulder straps and a back zipper closure.

Style 2446 is a dress constructed from woven fabric that is 60 percent wool/35 percent polyester and 5 percent other fibers. The fully lined sleeveless dress features a v-neckline and a back zipper closure. The neckline and sleeve openings have a contrasting color knit trim.

Style 2447 is a dress constructed from woven fabric that is 60 percent wool/ 35 percent polyester and 5 percent other fibers. The fully lined sleeveless dress features a round neckline and a back zipper closure.

These garments provide sufficient coverage to be worn without another outerwear garment.

Style 2448 is a jumper constructed from woven fabric that is 60 percent wool/ 35 percent polyester and 5 percent other fibers. The jumper features a front bib with a patch pocket, a rise in the back, shoulder straps that attach to the front bib with metal clasps and metal button closures, three metal button closure at each side and a simulated fly. The jumper also has two front pockets, one with a patch pocket sewn inside, back patch pockets and eight belt loops. This garment does not provide sufficient coverage to be worn without another outerwear garment.

The applicable subheading for styles 2433, 2434 will be 6204.43.4030, Harmonized Tariff Schedule of the United States (HTS), which provides for women's or girls' suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): dresses: of synthetic fibers: other: other: other: women's. The duty rate will be 16.8 percent ad valorem.

The applicable subheading for style 2442 will be 6204.43.3010, Harmonized Tariff Schedule of the United States (HTS), which provides for women's or girls' suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): dresses: of synthetic fibers: other: containing 36 percent or more by weight of wool or fine animal hair: women's. The duty rate will be 16.6 percent ad valorem.

The applicable subheading for styles 2446 and 2447 will be 6204.412010, Harmonized Tariff Schedule of the United States (HTS), which provides for women's or girls' suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): of wool or fine animal hair: other: women's. The duty rate will be 16.3 percent ad valorem.

The applicable subheading for style 2448 will be 6211.41.0040, Harmonized Tariff Schedule of the United States (HTS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women's or girls': of wool or fine animal hair: jumpers. The duty rate will be 16 percent ad valorem.

Styles 2433 and 2434 fall within textile category designation 636; styles 2442, 2446 and 2447 fall within textile category 436 and style 2448 falls within textile category 459. Based upon international textile trade agreements products of Hong Kong are subject to quota restraints and a visa requirement.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
